AstraZeneca today announced a settlement with the U. S. Food and Drug Administration (FDA) regarding a class action lawsuit filed by the plaintiffs. The settlement resolves claims that the drug was a “pre-market” drug that was “not approved for market” in the United States at the time it was made.
The settlement will be a part of the FDA’s approval of Crestor, a medication used to lower high cholesterol, as a statin treatment for patients who have been diagnosed with high cholesterol.
“This settlement allows us to fully implement AstraZeneca’s regulatory plan to make Crestor, the brand-name statin drug, available to patients at a time when it is not available in the U. today,” said Marc Bonnini, CEO of AstraZeneca.
“We are very pleased that the settlement resolves the class action,” said James W. Roth, President and CEO of the U. F. D. A. and a member of the class.
The settlement resolves the FDA-approved use of Crestor in the U. and includes a $500 million upfront payment, with the FDA allowing the drug to be marketed for other uses, including to treat a wide range of medical conditions.
